01 · Agreement
What these terms cover
These Terms of Service are entered into between you and Linkedd LLC, a Montana LLC, d/b/a AnswerBack (“Company,” “we,” “us,” or “our”). Who you are contracting with: AnswerBack is a brand of Linkedd LLC, a Montana limited liability company (file no. C1631496), 226 S Cruse Ave, Helena, MT 59601. They cover AnswerBack’s managed answering service for a plumbing business that uses the free pilot or a paid plan. By submitting a pilot request, proceeding with the pilot, or starting a paid plan, the business agrees to these terms and the Privacy Policy.
“Business,” “you,” or “your” means the plumbing business using the service and the person authorized to act for it. The Business is responsible for making sure the person accepting these terms has that authority.
02 · The service
What AnswerBack provides
AnswerBack is a managed answering service for plumbing businesses. AnswerBack sets up and manages call answering for the Business. Calls the Business chooses to forward to AnswerBack’s forwarding line, +1 334 986 3795, are answered on behalf of AnswerBack, which collects the caller’s name, service address, and a description of the plumbing issue, and AnswerBack passes those details to the Business. The Business contracts only with AnswerBack.
The forwarding line is AnswerBack’s own line (it is also AnswerBack’s main contact number). It is not a number assigned to or owned by the Business. The Business keeps its own business number and decides which calls to forward. Callers hear a notice at the start of the call that the call may be recorded.
Texts. During an answered call, AnswerBack may offer to send the caller a short follow-up text. A text is sent only if the caller agrees during the call. AnswerBack does not send automatic texts after missed or unanswered calls.
The free 14-day pilot
The pilot is free for one plumbing business. No payment card is collected and nothing is charged. The 14 days start when call forwarding has been set up and tested with the AnswerBack team; the pilot is not active merely because a request was submitted. When the pilot ends, it does not turn into a paid plan. Service continues only if the Business chooses a paid plan under section 03.
The service does not promise diagnosis, repair instructions, guaranteed appointments, dispatch, emergency services, a live transfer to a person, uninterrupted availability, or any particular business outcome. It does not replace the Business, its employees, a qualified plumber, emergency services, or the Business’s own customer-support process. Features not expressly described here are not included by implication.
03 · Paid plans
Renewal and how to cancel
After the pilot, the Business may choose a paid plan:
Monthly: $99 per month. Annual: $948 per year (equal to $79 per month, billed once a year).
Opt-in only. A paid plan starts only when the Business opts in at AnswerBack’s checkout by ticking a box that confirms the price, the automatic renewal, and how to cancel. Nothing is charged for the pilot, and the pilot never converts to a paid plan on its own.
Automatic renewal. Paid plans renew automatically at the end of each month (monthly plan) or year (annual plan), and the plan price is charged to the payment method on file on each renewal date, until the plan is canceled. We will not raise the price of an existing plan without giving advance written notice and a chance to cancel before the new price applies.
Payments. Payments are processed by Stripe through Linkedd LLC’s own Stripe account. Linkedd LLC d/b/a AnswerBack is the seller, the service provider, and the contracting party. Card details are entered on Stripe’s hosted checkout page; do not send full card numbers or security codes to AnswerBack by form, email, call, or text.
How to cancel (anytime)
- Online: go to www.answerback.online/billing/portal and enter the email address used at checkout. Stripe emails a secure sign-in link. Open it and choose Cancel plan.
- By email: write to hello@answerback.online from the billing email address with “Cancel” in the subject line.
- By phone: call +1 334 986 3795 and ask to cancel.
For email or phone requests, we cancel the plan and confirm by email. Cancellation stops the next renewal. Service continues until the end of the month or year already paid for, and no further charges are made. You don’t need to give a reason.
Refunds
The Cancellation & Refund Policy is incorporated into these Terms. It explains refunds for paid plans and how to request one.
04 · Your business
Responsibilities stay with the plumber
The Business remains responsible for its own plumbing services, service descriptions, pricing, licensing, insurance, permits, customer decisions, customer communications, emergency response, human follow-up, and compliance obligations. The Business must review and approve the information, scripts, boundaries, routing, and notification choices used in its configuration.
The Business must provide accurate information, keep its contact and routing details current, monitor the leads and messages it receives, and follow up with callers when appropriate. It must not treat an AnswerBack response as a diagnosis, quote, appointment, dispatch, or promise that a plumber will arrive.
The Business is also responsible for telling callers what they need to know about the Business’s services and communications, obtaining any consent required for calls or texts it causes or requests, and honoring caller requests to stop. For immediate, life-threatening danger, callers should be directed to 911; AnswerBack is not an emergency service.
05 · Acceptable use
Use it for the approved pilot
The Business may use the service only for its own plumbing-business call-answering needs, in a lawful and respectful way. It must not use the service to:
- misrepresent the Business, AnswerBack, a caller, or a person answering a call;
- send unlawful, deceptive, harassing, threatening, discriminatory, abusive, or unsolicited messages;
- request or transmit passwords, full payment-card details, government identification numbers, medical information, or other unnecessary sensitive information;
- use the service for emergencies, diagnosis, repair instructions, illegal activity, spam, fraud, or activity that could harm a caller;
- interfere with the service, probe it for unauthorized access, evade reasonable safeguards, or use it to test or build a competing service; or
- use the service for a different business, or for an expanded capability, unless AnswerBack has separately agreed and set it up.
We may pause or end use that creates a safety, legal, security, abuse, or operational risk. Where practical, we will communicate the reason and next step. This does not promise uninterrupted access or a particular notice period.
06 · Calls and texts
Consent and opt-out matter
The Business must forward to AnswerBack only calls to its own business lines and must follow applicable calling, recording, and messaging rules. Follow-up texts are sent only to callers who agree during an answered call. The Business must not upload, provide, or direct AnswerBack to text any phone number without the permission and notices required for that message, and must not ask AnswerBack to turn off the call-recording notice.
Recipients of AnswerBack texts can reply STOP to opt out or HELP for help. See the SMS Terms & Consent Policy for the messaging details. A recipient can also make a clear opt-out request by replying in the conversation or calling +1 334 986 3795. The Business must not ask AnswerBack to restart follow-up after an opt-out unless the recipient clearly re-consents through an appropriate process. STOP does not replace emergency guidance: call 911 for immediate, life-threatening danger.
Consent, opt-out, and caller details may be handled as described in the Privacy Policy. AnswerBack does not promise that every call, text, reply, or notification will be delivered or seen.
07 · Information and rights
Ownership and confidentiality
Each party keeps the intellectual property it owned or controlled before the pilot. AnswerBack retains its service, name, logos, software, workflows, documentation, and other materials it provides. The Business retains its business name, approved service information, content, and materials it provides. The Business gives AnswerBack permission to use the Business materials and pilot information only as needed to configure, provide, support, secure, and evaluate the pilot, subject to the Privacy Policy.
Each party should treat non-public business, operational, and customer information received from the other as confidential and use reasonable care to protect it. Confidential information may be shared with people or service providers who need it for the pilot and are expected to protect it, or when disclosure is required to comply with law, protect safety or rights, or address security or fraud. Information that is already public, independently developed, or lawfully received without a duty of confidence is not confidential under these terms.
Neither party receives ownership of the other party’s intellectual property merely because it participates in the pilot. Neither party may use the other’s name or marks as an endorsement without permission.
08 · Boundaries
No promise beyond the pilot
The service is limited to the current offer description and configured behavior. Availability, call routing, text delivery, carrier networks, connected systems, and other communications can be interrupted, delayed, unavailable, or affected by circumstances outside AnswerBack’s control. AnswerBack does not promise uninterrupted availability, a specific response time, a specific uptime, a specific conversion rate, more booked work, revenue, customer satisfaction, or any other result.
AnswerBack is not a plumbing contractor, emergency responder, dispatcher, insurer, or substitute for the Business’s judgment and human follow-up. The Business and its callers must make their own decisions about services, safety, pricing, licensing, and emergencies. Nothing on the site or in the pilot is legal, medical, safety, or professional advice.
Except to the extent applicable law does not allow a limitation, the pilot is provided without promises beyond the express description above. We do not state that the pilot will meet every Business need, be error-free, or be available in every situation.
Limitation of liability
To the extent permitted by applicable law, neither party will be responsible under these terms for indirect, incidental, special, consequential, exemplary, or punitive losses, or for lost profits, lost revenue, lost opportunities, or lost data. To the extent permitted by applicable law, AnswerBack’s total responsibility for claims arising from the service will not exceed the greater of $99 or the fees the Business paid AnswerBack in the three months before the claim arose. These limits do not create a promise that any particular claim is barred.
09 · Third-party claims
Indemnification
To the extent permitted by applicable law, each party will reasonably defend and indemnify the other party and its people against a third-party claim to the extent the claim results from the indemnifying party’s breach of these terms, negligence, willful misconduct, or violation of law. The Business’s responsibility includes third-party claims arising from its plumbing services, pricing, licensing, customer decisions, content, instructions, failure to obtain required consent, or failure to respond to a customer or emergency.
The party seeking protection should promptly notify the other of the claim and reasonably cooperate. The indemnifying party may control the defense, but may not settle a claim in a way that admits fault for or imposes a non-monetary obligation on the protected party without that party’s consent. These terms do not waive any protection or obligation that applicable law makes non-waivable.
10 · Changes and ending
Keep the terms current
We may update these terms when the published offer, pilot configuration, or relevant practices change. We will update the “Last updated” date. A material change should be made available in a reasonable way before it is relied on where appropriate. If the Business does not agree with a change, it should stop using the pilot and contact AnswerBack about the next step.
Either the Business or AnswerBack may end the pilot or stop a particular use where appropriate. Ending the pilot does not erase obligations that by their nature should continue, including payment records, confidentiality, intellectual-property rights, limitations, indemnification, or responsibility for prior conduct. The free pilot ends after 14 days; continued service requires a paid plan, which the Business can cancel at any time as described in section 03.
11 · Dispute resolution
Resolve issues in stages
Governing law. These Terms, and any dispute arising out of or relating to them or to the services, shall be governed by and construed in accordance with the laws of the State of Montana, without regard to its conflict-of-laws rules. Subject to the dispute-resolution process below, the state and federal courts located in Lewis and Clark County, Montana, shall have exclusive jurisdiction over any action that is not required to be arbitrated.
If a dispute arises, the parties agree to try to resolve it in good faith as follows:
- Good-faith negotiation. Either party may send written notice describing the dispute to the contact information above. The parties will attempt in good faith to resolve it within thirty (30) days of that notice.
- Mediation. If negotiation does not resolve the dispute, either party may require non-binding mediation administered by a mutually agreed mediator (or, if the parties cannot agree, by the American Arbitration Association) in Helena, Montana. Each party will bear its own costs; mediator fees will be split equally unless the mediator orders otherwise.
- Binding arbitration. If mediation does not resolve the dispute within sixty (60) days after the mediator is appointed (or such longer period as the parties agree in writing), the dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The seat of arbitration shall be Helena, Montana. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. You and the Company agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person or preside over any form of class or representative proceeding.
Small-claims exception. Either party may bring an individual action in small-claims court for disputes within that court’s jurisdiction.
Injunctive relief. Nothing in this section limits either party’s right to seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, or other rights that cannot adequately be protected by money damages.
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed. The remaining provisions shall continue in full force and effect. If the class-action waiver is found unenforceable as to a particular claim, that claim shall proceed in court and not in arbitration, and the remainder of this dispute-resolution section shall still apply to all other claims.
